Unexpected Police "Visit" to Lambdaistanbul Cultural Center

On 7 April 2008, during the afternoon around 5.30pm, a group of more than 12 plainclothes police came to the Lambdaistanbul Cultural Center with a search warrant. The policemen were reluctant to let the Lambda members present at the center to read the full text of the warrant, and they did not give satisfactory answers to members' questions on the subject.

The officers remained in the center for approximately two hours, during which time they examined the premises and all materials in the office, and also collected the identity cards of everyone who entered the center. At the end of their search they were not able to find evidence of a criminal offence; however, they took with them some important documents regarding Lambda's financial and membership systems.

The next day, Lambda's lawyer discovered that an accusation had been lodged against the association for participating in illegal prostitution activities, procuring transgender sex workers and sharing their earnings. Lambda has been informed that the police have been observing the cultural center and had taken note of frequent visits by transgender people. According to the public prosecutor, this was proof enough to issue a search warrant.

Lambda intends to seek legal action following the raid and we are currently consulting with our lawyers to decide the best way to proceed.

By a strange coincidence, our friends at Labrys in Kyrgyzstan were also raided by the police on the same day under the pretext of illegal prostitution activity, and were also forced to submit various papers. We are very proud and impressed by them for having the presence of mind to document the police's actions with video cameras, and we wish them the best of success as they prepare a response to this event.

Lambdaistanbul is also currently involved in a court case over the association's right to apply for official status as an organization, following a complaint by the city governorship that Lambda should be closed down as the group is a threat to Turkish family values and public decency. Our fifth hearing will be held on April 17. We are hoping that this case will be ruled in our favor but are prepared to appeal to the European Court of Human Rights if necessary.

Encore de l'homophobie primaire de la police et des autorités turques... Mais que doit-on attendre de gens qui se réfèrent constamment à la religion?

En tout cas on devrait faire une pétition en défense de cette organisation. Ca pourrait avoir une certaine influence.

Israel est un pays qui a fait énormément de progrès pour les droits des personnes LGBT en fait: preuve en est, les homosexuels peuvent sans problème faire leur service militaire et même accéder à des postes importants dans l'IDF (Tsahal). Je crois qu'Israel n'a toujours pas accordé le droit de mariage aux couples homosexuels, ou même l'adoption d'enfants par ces couples, mais il faut dire qu'Israel est bien plus en avance que tous les pays de la région sur cette question, y compris la Turquie, où pourtant l'homosexualité a été légalisé de longue date.

c'est quoi exactement comme asso Lamdaistanbul? qu'est-ce qu'on y fait de beau? et sur quoi se base la police pour les accuser?

Une "visite" innatendue au Centre Culturel de Lambdaistanbul.

Le 7 avril 2008, dans l'après midi, vers 17h30, un groupe de plus d'une
douzaine de policiers [en uniforme] sont venus au Centre Culturel de
Lambdaistanbul avec un mandat de perquisition. Les policiers se sont montrés
réticents à laisser les membres présentEs de Lambda lire le texte intégral
du mandat, et ils ne leur ont pas donné de réponses satisfaisantes là
dessus.

Les policiers sont restés environs deux heures dans le Centre, pendant
lesquelles ils ont inspecté les locaux et le matériel de bureau, et ont
aussi contrôlé les cartes d'identité de touTEs celleux qui sont entréEs dans
le Centre. A la fin de la perquisition ils étaient incapables de trouver
trace d'un quelconque délit ; malgré cela, ils ont emporté avec eux
d'importants documents sur les finances et les membres de Lambda.

Le lendemain, l'avocat de Lambda a découvert qu'une inculpation avait été
lancée contre l'association pour participation à des activités illégales de
prostitution, fourniture de travailleuses du sexe transgenre, et partage de
leurs gains. Lambda a été informé que la police avait surveillé le Centre
culturel et avait noté de fréquentes visites de personnes transgenre. Selon
le procureur, c'était une preuve suffisante pour délivrer un mandat de
perquisition.

Lambda à l'intention de lancer une action judiciaire après ce raid, et nous
sommes en consultation avec nos avocats afin de décider de la meilleure
manière d'agir.

Par une étrange coincidence, nos amiEs de Labrys au Kirghizstan ont subi
aussi une descente de police, le même jour, sous le prétexte d'activité
prostitutionelle illégale, et ont aussi été forcéEs de fournir divers
documents. Nous sommes très fières et impressionnéEs qu'ellils aient eu la
présence d'esprit de filmer l'action de la police avec des caméras vidéo, et
nous leur souhaitons le plus grand succès dans leur préparation d'une
réponse à cet évènement.

Lambdaistanbul est aussi, actuellement, impliquée dans une procédure au
sujet du droit de l'association à obtenir un statut officiel, sur une
plainte du gouvernorat de la ville selon laquelle Lambda devrait être fermé,
parce que ce groupe serait une menace pour les valeurs de la famille Turque
et la décence publique. Notre cinquième audience sera tenue le 17 avril.
Nous espérons que l'affaire sera jugée en notre faveur, mais nous sommes
prêtEs à faire appel à la Cour Européenne des Droits Humains si nécessaire.

Homophobia Out, Human Rights In;
This is the Last Stop!

The sixth hearing of the closing case of Lambdaistanbul LGBT Solidarity Association will be heard on May 29th, Thursday at 10 am. at the 3rd Civil Court in Beyoglu district of Istanbul (Beyoglu 3. Asliye Mahkemesi).

Lambdaistanbul LGBT Solidarity Association had, in fact, registered as an association two years ago, but due to the Istanbul City Government's interference with the claim that "an association cannot have an illegal or immoral basis", and with the help of our legal system, the process has been dragging on for two years.

We declare that this is the last stop and that there is nowhere else left to go from here for the Istanbul City Government, which has taken on as a mission, due to their homophobic moral stance to stop people from organizing simply because they are lesbians, gays, bisexuals and transgenders; and our legal system that has been dragging on this process with various alibis.

We say: "Homophobia Out, Human Rights In" and we invite you all to this hearing of the closing case, in order to show your support.
